The term “Personal Data” may include your name, your login, your address, your telephone number, your e-mail address, your age, your gender, your game preferences, for instance. Anonymous information, which we are not in a position to relate to you, does not qualify as “Personal Data”.

3.1. The Policy applies to the website https://www.mimaci.com, https://www.mimaci.eu, https://www.mimaci.sk and all associated websites (hereinafter jointly referred as the “Website”), to our online and mobile games (the “Game”), user account (the “Account”), and any of our other products and services (e.g. forums, support services, applications).


3.2. The Website, Game, Account and other products and services are reffered as the “Services”.


3.3. This Policy applies to all users of the Services (the User").


3.4. This Policy describes how we treat information that you provide to us or that we collect about you.

The policy is pursuant to article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) („GDPR“) and other legislation on data protection or data privacy („other legislation“).

7. Information We Collect and How We Collect it?


7.1. From the moment you begin interacting with the Services we are collecting information. This information includes information that identifies or can be used to identify you personally.


7.2. We may collect, use, store and transfer different kinds of personal data about you as follows:

- Personal and Account Data includes first name, last name, username or similar identifier, title, billing address, home address, e-mail address, telephone number, date of birth, time-zone;

- Transaction data includes details about payments to and from you and other details of products and services you have purchased from us;

- Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this Website;

- Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses;

- Usage Data includes information about how you use our website, products and services;

- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.


7.3. If you decide to make a payment for any of our products and services, your Financial Data, which includes your bank account and payment card details, will be collected by our external payment service provider. We will not have access, collect, use, store or transfer your Financial Data.


7.4. We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.


7.5. We do not collect any special categories of Personal Data about you e.g. your race, your religion, your health status, your biometric data or your criminal offence records.



8. What If You Fail To Provide Personal Data?


Where we need to collect Personal Data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

9.1. In relation to your use of our Services, we gather information either directly from you (when you provide information to us), or automatically (e.g. through our Site’s technology) or from third parties.


9.2. Information We Collect Directly from You

We collect Personal Data and other information that you voluntarily provide. It is entirely your decision to provide the requested information. However, your use of certain Services is possible only if you provide required information, e.g. while creating an Account.


9.3. Information We Collect Automatically

We automatically collect a variety of information through your interaction with our websites and other Services. This information may include, but is not limited to, browser and device information, data collected through automated electronic interactions, application usage data, demographic information, geographic, geo-location information, statistical and aggregated information.

9.4. Information from Third Parties

Sometimes we obtain information from third parties to use along with the information we collect. For example, if you make an payment through third-party payment service provider, they will give us an information about your payment in accordance with payment service provider’s privacy policy and your privacy settings on it. Or if you link your Facebook account with your Account, Facebook may share info with us.



10. Why We Collect and Process Your Personal Data?


10.1. We collect and process Personal Data for the following reasons:

- necessity for the performance of the contract or any other feature you request or enable;

- legal obligation;

- legitimate interest;

- consent.


10.2. We collect and process your Personal Data where it is necessary for the performance of our contract with you to provide a full-featured Services and deliver associated Services (e.g. account functionality, customer service, service and product functionality, parental control, purchases).


10.3. We collect and process your Personal Data where it is necessary for compliance with legal obligations that we are subject to (e.g. our obligations to keep certain information under tax laws, legal compliance, litigation or pre-litigation, security monitoring and investigations).


10.4. We collect and process your Personal Data where it is necessary for the purposes of the legitimate and legal interests of us or a third party (e.g. the interests of our other customers), except where such interests are overridden by your prevailing legitimate interests and rights. This necessity is e.g. in analytics and data segmentation, business optimization, service development, research, training, marketing campaigns, ad targeting via paid media, ad targeting via custom audience and similar systems, appropriate ads for Users considering their previous purchases, customer support, abuse and cheat detention and sanctions. We see this processing as necessary for the purposes of the legitimate interests pursued by us, in line with art. 6.1.(f) of the GDPR. In such case, we will carefully assess whether there are compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

11. How We Use Your Personal Data?


We will use your Personal Data, unless otherwise prohibited by law, for example for the following purposes:

- To send you a welcoming email and to contact you about your use of the Service;

12. With whom may we share your data?


12.1. We generally do not sell or trade any Personal Data about our customers, prospects, or visitors to any third parties. We cooperate with various third parties to provide the Services or perform certain functions on our behalf. If we share your information with these third parties, we will only provide them with information they reasonably need to perform their specific services for the purposes we specify in our contract with them, although we may permit them to use information that does not identify you for other purposes. If we stop using their services, we will require that any of your information that they hold be securely and permanently deleted or de-identified so that it does not identify you. In all cases, we will apply measures to help keep your data safe and your privacy protected.


12.2. Here are some examples of the categories of third parties with which we may share your Parsonal Data:

- Payment partners: we share your Personal data you provide to us for the purpose of fulfilling your purchase requests;

- Ad partners: E.g. Google or Facebook, so that they can show you products that might interest you;

- Data storage and IT partners: these partners develop our Services, support our websites and Services, store some of your information using third-party data storage services, detect, investigate and prevent the cheating etc.;

- Agents, Consultants and Related Third Parties: Like many businesses, we sometimes hire other companies or individuals to perform certain business-related functions.

- Law firms and authorities: For legal reasons or in the event of a dispute.


12.3. Generally we do not intend to share your Personal data with third parties outside the European Union or the European Economic Area. Nonetheless, when your personal data is shared with third parties outside the European Union or the European Economic Area, we guarantee an adequate level of personal data protection, including but not limited to, by entering into standard data protection clauses adopted by the European Commission third parties. We will provide you with a copy of the standard data protection clauses upon your request, where applicable.



13. How Long Will We Keep Your Personal Data for?


13.1. Except as otherwise permitted or required by applicable law or regulatory requirements, we will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.


13.2. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.



14. Security measures


Because of the constant risk associated with the provision of personal data, whether in person, by telephone or through the Internet, and because no technology system is absolutely safe and resistant to hackers, the Company has taken measures to prevent and minimize the risk of unauthorized access, misuse or inaccuracies of the Personal Data. When collecting or transmitting sensitive data, e.g. information about the payment card, the Company uses the encryption technology.



15. What rights do you have?


15.1. You have the following rights, in certain circumstances, in relation to your Personal Data:

- Right to data portability,

- Right to object,

- Right to withdraw,

- Right to file a complaint.


15.2. Right of Access

You have the right to receive a report about the Personal Data we store about you, i.e. the right to require free of charge

- information whether your Personal Data is retained,

- access to the Personal Data and/or

- duplicates of the Personal Data retained.


15.3. Right to Rectification

You have the right to rectification and/or completion of your Personal Data, provided that the processed Personal Data concerning you is incorrect or incomplete. Please inform us if any of the Personal Data we retain about you is inaccurate.


15.4. Right to Erasure

You have the right to obtain deletion of Personal Data concerning you by our Company. If you choose to have your Personal Data removed from our active databases, we will try to do so within a reasonable time after your request and we will take reasonable steps to ensure that your Personal Data is not used (except as may be required or permitted by law) by us after your notification to us.

Please note that, where required or permitted by law, we may need to retain certain information for legal or legitimate purposes i.e. to complete any transactions that you began prior to requesting deletion.

As a result of deleting your Account, you will lose access to most Services.


15.5. Right to Restriction

You may also have the right to request us to restrict the processing of your Personal Data, for example if you object to its processing, but prefer the data not to be erased.


15.6. Right to Data Portability

Data portability is the ability to move data from one company to another (for instance, when you transfer your mobile phone service to another carrier). While this right is not very applicable to our Services, we will provide you with an electronic file with your most basic account information, should you request it.


15.7. Right to object

Where processing of your Personal Data is based on legitimate interests according to Article 6 para 1 (f) of the GDPR or on the ground of Article 6 para 1 (e) of the GDPR, you can use your right to object at any time. If you object we will no longer process your Personal Data unless there are compelling and prevailing legitimate grounds for the processing or the data is necessary for the establishment, exercise or defense of legal claims.

You have the right not to be subjected to a decision based solely on automated processing, which will have legal effect or similarly affect you in a similar manner. This does not apply if the decision

a) is required to conclude or carry out a contract between you and the responsible party,

b) is permissible on the basis of the EU or member state law to which the responsible party is subject, and that legislation contains suitable measures to safeguard your rights and freedoms and your legitimate interests, or

c) is made with your explicit consent.


15.8. Right to Withdraw

Where we are relying on consent to process your Personal Data, you have the right to withdraw consent at any time. This will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.


15.9. Right to File a Complaint

You have the right to lodge a complaint regarding our collection, processing, or storage of your Personal Data with a data protection supervisory authority in a country where you live, work, or where you believe a breach may have occurred.


15.10. If you would like to exercise these rights, please contact our Company at mimaci@mimaci.com. We will aim to respond to you within 30 days from receipt of request. We will need to verify your identity before we are able to disclose any personal data to you.



16. Data Obtained from Minors


16.1. Parents shall instruct their children to never give out their real names, addresses, phone numbers and other personal data without permission when they are on-line.


16.2. Once a minor states that his/her age is under 16 or the age needed to consent to the processing of personal data in his/her country, the minor will be unable to register an account in this website. We do not knowingly collect or store any personally identifiable information from minors under the age of 16 or the age needed to consent to the processing of personal data.


16.3. If we learn that we have collected Personal Data of a minor under 16 or the age needed to consent to the processing of personal data, and we do not have parental consent, we will take steps to delete such information from our files as soon as possible.


16.4. If parents believe that we have unintentionally collected their minor’s Personal data, they may request the deletion of the information by contacting us at mimaci@mimaci.com.

17.2. Each EU Member State shall provide one or more independent public authority (ies) to be responsible for monitoring the application of the GDPR in order to protect the fundamental rights and freedoms of natural persons in relation to processing and to facilitate the free flow of personal data within the Union (supervisory authority). If you feel that we have violated your rights, or if you wish to raise a concern with the data protection authorities, please contact the supervisory authority in the country where you live, work, or where you believe a breach of data protection law has occurred.


18. Amendment of the Policy


We are entitled to alter or amend the Policy at any time. The amendment is effective as of the publication of the new version of the Policy.
